1. About Our Services

We aim to provide you with high quality services which can be used at any time. However the nature of our services means that we cannot promise that they will always be available or working properly. This is largely because our services rely on networks and equipment which we do not control.

If there is a problem with our service we will try and remedy it as soon as we can. If you experience any problems with our service please let us know by calling 03 203 9999. We will try to address the problem in a timely fashion.

 

2. Paying for our services

You must pay our charges for the services we provide. If someone else uses the services we provide to you, you are still responsible for payment. All customers who sign up for an ISPNZ B-Band plan will be billed in advance at the start of each month. All new monthly charged accounts will be debited from a supplied credit card unless prior arrangements have been made with ISPNZ.

We may suspend or restrict your ability to use our services if any payment becomes overdue.

If you have any questions about your bill, or you think there is a mistake in your bill, then please contact us as soon as possible on 03 203 9999. If we agree that there has been a mistake in your bill we will fix it.

 

3. Your responsibilities

You agree:

• to make sure that all information you give us is correct
• to follow the instructions we give you and comply with any restrictions we impose regarding your use of our services
• to keep any password or security code which relates to our services confidential, and to change the password or security code if we request you to do so
• to notify us immediately if you believe that someone else has discovered your password or security code or has made any fraudulent use of the services we provide to you
• to notify us immediately of any change of your address or phone number.

You agree not to use our services:

• in a way which breaks any law or infringes anyone's legal rights (such as copyright)
• to obtain unauthorised access to anyone's system
• in a way which could cause physical or other damage to anyone's system
• in a way which is offensive, abusive or is likely to be a nuisance to someone else.

If you do not comply with these obligations, and we incur costs as a result, then you must pay those costs. In addition, we can remove from our server any material which we consider breaches these terms.

 

4. Internet Services

In relation to our internet services:

• you must not use your account to access the internet from more than one machine at any one time.
• If you use our virus filter then you acknowledge that that service works by endeavoring to prevent our mail servers from forwarding contaminated emails to the recipient. However we cannot guarantee that the service will prevent all viruses from being forwarded (for example, it may not identify new viruses) and the service will not filter out viruses that do not pass through our mail servers (such as viruses contained on "Hotmail" or contaminated disks). Because of this we recommend that you install anti-virus software.
• We reserve the right to change the nature of a plan (speed, data, price) with one month's written notice.
• Plan speed refers to the maximum speed - actual speed depends on a variety of factors and some customers may never achieve maximum speed. Please see the ihug website for further details.

5. Privacy

From time to time you may give us personal information, such as your address and other details. If you do not give us this information we may not be able to provide you with services. Personal information about you may also be generated as a result of your use of our services.

We will treat your personal information in a manner which meets the requirements of the Privacy Act.

 

6. Limitation of Liability

We aim to provide you with high quality services which can be used at any time. However the nature of our services means that we cannot promise that this will always be the case. The provider is not Liable for the consequences of the user or misuse of the Service. Neither is the Provider liable for any losses caused by the non-availability of the Service.

 

7. Termination of Service

The Provider may terminate the Service at any time as long as the Client is given one weeks written notice of such termination. The requirements for notice to be given does not apply if the Client is in breach of these conditions. The Client may terminate the Service by notifying the Provider in writing, effective on receipt of such notification

 

8. Changing these terms

These terms and conditions may be varied by the Provider; ISPNZ Ltd. at any time, so long as the Client is given one weeks written notice of such variation.
